Ordinance 17-03ORDINANCE NO. 2017-03 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EASTVALE, CALIFORNIA, AMENDING CHAPTER 2 TO REQUIRE A CONDITIONAL USE PERMIT FOR "INDOOR AMUSEMENT/ENTERTAINMENT FACILITY" AND CHAPTER 4 TO MODIFY THE STANDARDS FOR A FREEWAY SIGN IN THE GOODMAN COMMERCE CENTER AT EASTVALE SPECIFIC PLAN WHICH COVERS APPROXIMATELY 205 ACRES OF THE REAL PROPERTIES LOCATED GENERALLY NORTH OF BELLEGRAVE AVENUE, SOUTH OF CANTU-GALLEANO RANCH ROAD, EAST OF HAMNER AVENUE, AND WEST OF I-15, BORDERED BY THE CITY OF ONTARIO TO THE WEST. The City Council of the City of Eastvale does hereby ordain as follows: SECTION 1. The proposed Specific Plan Amendment is subject to the California Environmental Quality Act (CEQA). Finding 1: The proposed project does not require the adoption of an addendum to the certified Environmental Impact Report (EIR) pursuant to Section 15090 of the CEQA Guidelines. Evidence: On May 10, 2017, the City Council of the City of Eastvale conducted a duly noticed public hearing, at which time it received public testimony concerning proposed Project No. 17- 20001, and determined that no additional CEQA analysis is required because the proposed changes do not introduce new uses which would create impacts not already addressed and mitigated in the Final Environmental Impact Report (FEIR)n for the Specific Plan (SCH# 2011111012) certified by the City Council through Resolution No. 14-32 and adopted on June 11, 2014. Therefore, the certified FEIR is still valid for the proposed Specific Plan Amendment. A Notice of Determination will be filed for the adoption of the proposed Specific Plan Amendment. SECTION 2. Pursuant to the City of Eastvale Zoning Code, the following findings pertaining to the adoption of a Specific Plan Amendment (Project No. 17-20001) to the Goodman Commerce Center at Eastvale Specific Plan are required: Finding 1: The proposed Specific Plan is consistent with the goals, policies, and objectives of the City's General Plan. Evidence: The proposed amendment to the Specific Plan changes the text in portions of Chapters 2 and 4 of the Goodman Commerce Center at Eastvale Specific Plan. The changes are made to better create consistency for processing "Indoor Amusement/Entertainment Facility" within the business park and to modify the standards for freeway sign to accommodate the applicant's new design for the sign. The changes identified in the Specific Plan Amendment are compatible with surrounding land uses and are consistent with the goals and policies General Plan. Finding 2: The proposed specific plan meets the requirements set forth in the Eastvale Zoning Code. Evidence: Section 2.5 of the Zoning Code identifies mandatory contents of the Specific Plan such as a description of the site, available public services and facilities, capacity of existing and planned circulation system, proposed land uses, development standards for each land use categories and signs, a time schedule for development, and procedure for review of proposed development, etc. The Goodman Commerce Center at Eastvale Specific Plan meets the requirements of the Zoning Code for Specific Plan content. As required, Chapter 2 of the Specific Plan contains development standards related to land use, transportation facilities, landscaping, and grading. The proposed amendment to Chapter 2 does not change any land uses but rather ensures that Indoor Amusement/Entertainment Facilities can be effectively regulated so those uses would not negatively disrupt neighbors across Bellegrave Avenue from the Business Park, or other tenants in the Business Park, Chapter 4 includes comprehensive sign criteria and requirements specific to the Industrial land use portion of the Specific Plan area. Changing the allowable area for the freeway sign would accommodate the applicant's proposed design for the freeway sign while being consistent the maximum height and width currently allowed in the Specific Plan. Finding 3: The language and contents of the Specific Plan must meet all mandatory contents required in Section 2.5 of the Zoning Code. Evidence: The proposed amendment to the Goodman Commerce Center at Eastvale Specific Plan has been examined to ensure the proposed amendment(s) contain the mandatory contents required under Section 2,5 of the Zoning Code. SECTION 3. The City Council hereby adopts a Specific Plan Amendment to amend Chapter 2 to require a conditional use permit for `Indoor Amusement/Entertainment facility" and Chapter 4 to modify the standards for freeway sign in the Goodman Commerce Center at Eastvale Specific Plan as described and attached Hereto as Exhibit A. SECTION 4. This ordinance shall take effect and be in full force and operation thirty (30) days after adoption. SECTION 5. If any section, subsection, subdivision, sentence, clause, or portion of this ordinance is for any reason hell to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of the ordinance. The City Council hereby declares that it would have adopted this ordinance, and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof; irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional. SECTION 6. The City Clerk shall certify to the adoption of this ordinance and shall cause the same to be published in accordance with law. PASSED, APPROVED, AND ORDAINED this 24`x' day of M.ay-2-0Y7.
