AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EASTVALE,
CALIFORNIA, ADOPTING AN AMENDMENT TO EASTVALE ZONING CODE
SECTION 5.8(D)(3)(A) TO REPLACE A REQUIREMENT THAT ALL YARDS BE
MAINTAINED "AESTHETICALLY CONSISTENT" WITH OTHERS IN THE
NEIGHBORHOOD WITH DEFINED STANDARDS FOR MAINTENANCE.
The City Council of the City of Eastvale does hereby ordain as follows:
SECTION 1. California Environmental Quality Act
Finding: The proposed Amendment to the Eastvale Zoning Code is not subject to the California
Environmental Quality Act (CEQA), based on CEQA Guidelines Sections 15378 and 15060(c).
Evidence: The proposed project is limited to a clarification of front yard maintenance standards for
use by City of Eastvale Code Enforcement. The standards include general yard maintenance
requirements and plant care standards. The revision of the Zoning Code to include the proposed
language would not result in a direct or reasonably foreseeable physical change in the environment,
and as a result, does not meet the definition of a project under the California Environmental Quality
Act (CEQA), CEQA Guidelines Sections 15378 and 15060(c). No evaluation or action under CEQA
is required.
SECTION 2. Pursuant to the City of Eastvale Zoning Code, the City Council hereby makes the
findings below pertaining to an Amendment to Zoning Code Section 5.8(D)(3)(a).
Finding 1: The proposed Zoning Code Amendment is consistent with the goals, policies, and
objectives of the General Plan.
Evidence: The proposed amendment is to remove the language requiring all front and side yards to
be maintained "in an aesthetically consistent manner with the rest of the neighborhood." (essentially
requiring that all yards look the same); and clarifying what is considered a "well-maintained" yard.
The standards include general yard maintenance requirements and plant care standards. These
changes would provide the City with reasonable, enforceable standards that can be used by the City
of Eastvale Code Enforcement staff to ensure that neighborhoods remain attractive as identified in
the City General Plan. Therefore, the proposed amendment is consistent with the General Plan.
SECTION 3. The City Council hereby adopts the Zoning Code Amendment to Section 5.8(1))(3)(a)
of the Eastvale Zoning Code as shown in Exhibit "A" attached hereto.
SECTION 4. This ordinance shall take effect and be in full force and operation thirty (30) days after
adoption.
SECTION 5. If any section, subsection, subdivision, sentence, clause, or portion of this ordinance is
for any reason held to be invalid or unconstitutional by the decision of any court of competent
Jurisdiction, such decision shall not affect the validity of the remaining portions of the ordinance.
The City Council hereby declares that it would have adopted this ordinance, and each section,
subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any
one or more sections, subsections, sentences, clauses, phrases, or portions thereof be declared invalid
or unconstitutional.
SECTION 6. The City Clerk shall certify to the adoption of this ordinance and shall cause the same
to be published in accordance with law.
