AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EASTVALE,
CALIFORNIA, DESIGNATING 15.77-ACRE REAL PROPERTY LOCATED AT
SOUTHEAST CORNER OF CITRUS STREET AND SCHOLAR WAY (ASSESSOR'S
PARCEL NUMBER 152-050-050) WITH A SENIOR HOUSING OVERLAY DISTRICT
The City Council of the City of Eastvale does hereby ordain as follows:
SECTION 1. The Change of Zone is subject to the California Environmental Quality Act (CEQA).
Finding 1: The proposed Change of Zone to designate the 15.77-acre site with a Senior Housing
Overlay District is not subject to the California Environmental Quality Act (CEQA), based on
CEQA Guidelines Section 15378.
Evidence: The proposed addition of the senior overlay district to this property would not result in
direct or indirect physical impacts to the environment. The senior overlay district would allow
housing consistent with underlying general plan land use designation and zoning district to be
constructed. The only change would be that the housing would have age-restricted residency
requirements. As the overlay zone does not change the intensity of development or the land
available for development, it would not result in direct or indirect physical impacts to the
environment.
In addition, impacts from future development on this site would be speculative given that there is no
development proposal pending. Future development proposing senior housing would be subject to a
Major Development Review and would be considered a project under CEQA. The consideration of
an application for a Major Development Review is considered a discretionary action, and requires a
project-level analysis as a part of the application process.
SECTION 2. Pursuant to the City of Eastvale Zoning Code, the City Council hereby makes the
findings below pertaining to the Change of Zone to designate the 15.77-acre site with a Senior
Housing Overlay District.
Finding 1: The proposed Change of Zone is consistent with the goals, policies, and objectives of the
General Plan.
Evidence: The proposed change of zone to designate the site with a senior housing overlay district is
consistent with the General Plan for providing a wide variety of housing stocks. The senior housing
overlay district does not increase density, does not relax development standards, and does not allow
for special incentives through development agreements. Application of the overlay would permit
housing densities in accordance with the General Plan and Zoning Code but would have the effect of
limiting impacts to schools and roadways as senior housing does not have the same levels of impact
as non-age-restricted housing. The designation of the site would promote senior housing
development at this location.
SECTION 3. The Official Zoning Map for the City of Eastvale is hereby amended to designate the
15.77-acre site (Assessor's Parcel Number 152-050-050) with a Senior Housing Overlay District as
illustrated in Exhibit "A" attached hereto.
