Ordinance 19-11ORDINANCE NO. 2019-11 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EASTVALE, CALIFORNIA, AMENDING TITLE 110 OF THE EASTVALE MUNICIPAL CODE TO ADOPT THE 2019 EDITION OF THE CALIFORNIA BUILDING STANDARDS CODE (CALIFORNIA CODE OF REGULATIONS, TITLE 24, PARTS 2 THROUGH 12, INCLUSIVE), WITH SPECIFIED APPENDICES, AND INCLUDING ALL AMENDMENTS THERETO. WHEREAS, the 2019 California Building Code was published by the California Building Standards Commission on July 1, 2019 and will be implemented on January 1, 2020; WHEREAS, all requested permits or applications received by the City after January 1, 2020 will need to comply with these updated measures; and WHEREAS, the 2019 California Building Code includes updated codes for the following: the CA Administrative Code, CA Building Code, CA Residential Code, CA Electrical Code, CA Mechanical Code, CA Plumbing Code, CA Energy Code, CA State Historical Building Code, CA Fire Code, CA Existing Building Code, CA Green Building Code, and CA Reference Standards Code. THE CITY COUNCIL OF THE CITY OF EASTVALE DOES ORDAIN AS FOLLOWS: SECTION 1: COMPLIANCE WITH CEOA. The City Council hereby finds that the action to adopt this Ordinance is exempt from the provisions of the California Environmental Quality Act (Public Resources Code Section 21000, et seq.) (CEQA) because the action is exempt from environmental review under CEQA Guidelines Section 15061(b)(3). The activity is covered by the general rule which exempts activities that can be seen with certainty to have no possibility for causing a significant effect on the environment. The Ordinance introduces standards to regulate certain behavior to protect the health, safety, and public welfare, and does not authorize activities or development that could potentially have a physical impact on the environment. Buildings and development projects that are subject to CEQA are reviewed individually priorto issuance of building permit. Moreover, State law provides that the 2019 Building Codes will take effect in the City even if the City does not adopt this ordinance, as is required by law. Accordingly, the City Council hereby finds that it can be seen with certainty that there is no possibility the adoption and implementation ofthis Ordinance may have a significant effect on the environment. SECTION 2: AMENDMENT OF CHAPTER 110.04. SectionllO.04.010 of the Eastvale Municipal Code is amended as follows: "110.04.010 Adoption by Reference-Building Code. The 2019 California Building Code (California Code of Regulations, Title 24, Part 2), along with Appendices, as published by the California Building Standards Commission, is hereby adopted by reference and incorporated into this Title 110 of the Eastvale Municipal Code. A copy of the 2019 California Building code, including the above-designated appendices, shall be on file in the office of the City Clerk."
