Ordinance 21-02ORDINANCE NO. 21-02 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EASTVALE, CALIFORNIA, ADDING SECTION 120.04.160 TO CHAPTER 120.04 OF THE EASTVALE MUNICIPAL CODE REGARDING SHORT-TERM RENTALS WHEREAS, a central and significant goal for the City of Eastvale ("City") is preservation of its housing stock and preserving the quality and character of residential neighborhoods; and WHEREAS, operations of short-term rentals, where residents rent to visitors frequently disrupt the residential character of the neighborhoods and adversely impact the community; and WHEREAS, the City Council now desires to clarify and expand upon its existing prohibition of short-term rentals to better assist in enforcement of their prohibition. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EASTAVLE DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Section 120.04.160 is hereby added to the Eastvale Municipal Code as follows: Section 120.04.160 Short-term rentals. (a) Definitions. For purposes of this Section, the following words or phrases shall have the following meanings: (1) Person. Any natural person, joint venture, joint stock company, partnership, association, club, company, corporation, business trust or organization of any kind. (2) Short-term rental. Renting for a period of thirty consecutive calendar days or less any dwelling unit, in whole or in part, for transient use. (3) Transient. Any person who exercises occupancy or is entitled to occupancy of a dwelling unit, in whole or in part, for a period of thirty consecutive calendar days or less. (b) Short-term rental prohibition. No person shall undertake, maintain, authorize, aid, facilitate or advertise any short-term rental within the City. (c) Enforcement. (1) Any person violating any provision in this section shall be guilty of an infraction or a misdemeanor punishable in accordance with Section 1.01.220 of this Code. RIV #4848-6893-2052 vl
