Ordinance 11-02ORDINANCE NO. 2011-02 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EASTVALE, CALIFORNIA, ADDING CHAPTER 12.02 OF TITLE 12 TO THE EASTV ALE MUNICIPAL CODE ESTABLISHING THE SPEED LIMITS ON CERTAIN STREETS WHEREAS, Ca1ifornia Vehicle Code Sections 22357 and 22358 provide that local entities may declare prima facie speed limits of more than 25 miles per hour on City streets on the basis of an engineering and traffic survey; and WHEREAS, California Vehicle Code Section 40802 provides for the enforcement of the posted speed limit by the use of radar or other electronic devices which measures the speed of moving objects; and WHEREAS, California Vehicle Code Section 627 defines an engineering and traffic survey to include consideration of all of the following: 1) Prevailing speeds as determined by traffic engineering measurements; 2) Accident Records; 3) Highway, traffic, and roadside conditions not readily apparent to the driver; and WHEREAS, the City ofEastvale has completed a new engineering and traffic survey pursuant to California Vehicle Code Section 22357 and 22358. THE CITY COUNCIL OF THE CITY OF EASTV ALE, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. FINDINGS. The City Council of the City of Eastvale finds that an Engineering and Traffic Survey has been completed in full compliance with the requirements of the California Vehicle Code and the recommendations in the Survey should be implemented. Based upon the review of the Survey and related information, the City Council finds the prevailing or 85th percentile speeds of the vehicles are: Roadway Segment 35th Percentile Speed Hamner A venue -Riverside Drive to Belle grave A venue 52 Miles per Hour Hamner Avenue-Bellegrave Avenue to Limonite Avenue42 Miles per Hour Hamner Avenue-Limonite Avenue to Citrus Street 51 Miles per Hour {00004859.DOCX Vl}l Based on the review of the Survey, the City Council finds that the most appropriate speed limits to facilitate the orderly movement of traffic that is reasonable and safe for the above-listed streets are set forth herein. SECTION 2. AMENDMENT TO CODE. The following chapter is added to Title 12 (Vehicles and Traffic) of the Eastvale Municipal Code to read as follows: CHAPTER 12.02.010-SPEED LIMITS ESTABLISHED • Hamner A venue -Between Riverside Drive and Bellegrave A venue shall be 50 Miles Per Hour; • Hamner A venue -Between BelJegrave A venue and Limonite A venue shal1 be 40 Miles Per Hour; and • Hamner A venue -Between Limonite A venue and Citrus Street shaH be 50 Miles per Hour. SECTION 3. DIRECTION TO CITY TRAFFIC ENGINEER. On or after the effective date of this Ordinance, the City Engineer is directed to clearly post speed limit signs effectuating Section 2, above, to give notice that this Ordinance is in effect. SECTION 4. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance, and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases or portions thereof be declared invalid or unconstitutional. SECTION 5. Upon the effective date of this Ordinance, the provisions hereof shall supersede any conflicting provisions of the Codified Ordinances of the County of Riverside as the same were adopted by City Ordinance No. 2010-01. SECTION 6.
