Ordinance 11-04ORDINANCE NO. 2011-04 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EASTVALE, CALIFORNIA, ADOPTING THE RIVERSIDE COUNTY CODE AND OTHER RELEVANT NON-CODIFIED RIVERSIDE COUNTY ORDINANCES AS CITY ORDINANCES UNTIL SUPERSEDED BY OTHER CITY ORDINANCES THE CITY COUNCIL OF THE CITY OF EASTVALE DOES ORDAIN AS FOLLOWS: SECTION 1. COUNTY ORDINANCES TO REMAIN IN EFFECT. (a) Pursuant to the provisions of California Government Code Section 57376, all ordinances of the County of Riverside which have been applicable within the territory now incorporated as the City of Eastvale shall remain in full force and effect as ordinances of the City of Eastvale. (b) Additionally, the resolutions, rules and regulations of the County of Riverside which have been applicable in the implementation of the aforesaid ordinances and State laws (including, but not limited to, the California Environmental Quality Act and regulations pertaining to traffic) to the extent that they applied before incorporation shall remain in full force and effect as resolutions, rules and regulations, respectively, of the City of Eastvale. (c) Each ordinance or resolution of the County of Riverside which remains in effect as set out in this Section shall remain in effect as a City ordinance until the City Council enacts other ordinances superseding them. SECTION 2. SUBSTITUTION OF REFERENCES TO "CITY." Certain County ordinances and resolutions referred to in Section 1 reflect the County's governmental structure and contain references to officials, titles, commissions and other designations which are not part of the structure of the City. In order to effectively administer such County ordinances and resolutions, this ordinance also provides for the substitution of the appropriate City official, title or designation, including but not limited to those which follow: (a) Whenever "Board of Supervisors" or "Board" is used in the County Code or relevant county ordinances or resolutions, it shall mean the Eastvale City Council. (b) Whenever "County" or "County of Riverside" is used in the County Code or relevant County ordinances, it shall mean the jurisdictional limits of the City of Eastvale unless a different geographical or jurisdictional area is clearly indicated by the context. (c) Whenever "unincorporated territory of the County of Riverside" issued in the County Code or relevant County ordinances, it shall mean the City of Eastvale unless a different geographical area is clearly indicated by the context. (d) Whenever "Planning Commission," "Board of Zoning Adjustment," "Board of Appeals," "Zoning Administrator or any similar reference to a County person or body is used, it shall mean the Eastvale City Council or those agencies, Commissions or officials acting as the agents of the City of Eastvale. {00004874.DOCX VI} SECTION 3. URGENCY This urgency ordinance is an extension of Ordinance No. 2010-01 enacted pursuant to Government Code Section 36937 for the immediate protection of the public health, welfare, and general safety in that the City has not had sufficient time to enact all of its own ordinances and the residents of Eastvale need and require the benefit of all health and safety laws of the County of Riverside effective from October 1, 2010, until City ordinances are in place. SECTION 4. The City Clerk shall certify the adoption of this Ordinance and shall cause the same to be posted as required by law.
