AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EASTV ALE
APPROVING A DEVELOPMENT AGREEMENT WITH SAN DIEGO OUTDOOR
ADVERTISING, INC. dba GENERAL OUTDOOR ADVERTISING.
THE CITY COUNCIL OF THE CITY OF EASTV ALE ORDAINS AS FOLLOWS:
SECTION 1. The City Council finds:
WHEREAS, the California Outdoor Advertising Act, Business and Professions Code, Section
5200, et. seq. encourages local entities and display owners to enter into agreements which allow
local entities to continue development in a planned manner without expenditure of public funds
while allowing the continued maintenance of private investment and a medium of public
communications;
WHEREAS, the California Outdoor Advertising Act specifically empowers, and encourages,
local agencies to enter into agreements on whatever terms are agreeable to the City and display
owners and to adopt ordinances and resolutions providing for displays;
WHEREAS, Policy DE-52 in the Design Chapter of the Eastvale General Plan specifically
provides for the construction of one Freeway Oriented Electronic Billboard;
WHEREAS, Section 5.7.D.6 of the Eastvale Zoning Code implements the General Plan by
allowing the development of one Freeway Oriented Electronic Billboard, subject to approval of a
Development Agreement by the City;
WHEREAS, San Diego Outdoor Advertising, Inc. dba General Outdoor Advertising desires to
construct one Freeway Oriented Electronic Billboard incorporating a changeable Message
Display Center, consistent with General Plan Policy DE-52 and the requirements of the Eastvale
Zoning Code;
WHEREAS, As required by the Eastvale Zoning Code, on July 18, 2012 the Planning
Commission reviewed a variety of proposed designs for the sign and recommended the design of
the proposed Freeway Oriented Electronic Billboard to the City Council.
WHEREAS, On August 8, 2012, the City Council held a duly noticed public hearing at which it
considered all public testimony pro and con as well as materials in the staff report and
accompanying documents, all of which materials constitute the record of such hearing and finds
that:

1. The proposed Freeway Oriented Electronic Billboard is consistent with the
applicable General Plan objectives, policies and programs and fulfills General
Plan Policy DE-52.

2. The proposed Freeway Oriented Electronic Billboard is compatible with
Section 5.7.D.6 of the Eastvale Zoning Code which implements the General Plan
by allowing the development of one Freeway Oriented Electronic Billboard,
subject to approval of a Development Agreement by the City on the real property
which it will be located.
3. The proposed Development Agreement is in conformity with and will
promote public convenience, general welfare and good land use practice.
4. The proposed Development Agreement will not be detrimental to the
health, safety and general welfare within the City.
5. The proposed Development Agreement will not adversely affect the
orderly development of the property or the preservation of property values.
6. The proposed Development Agreement will promote and encourage the
development of the proposed Site by providing a greater degree of requisite
certainty for the developer.
7. The proposed Development Agreement is consistent with the California
Outdoor Advertising Act, Business and Professions Code, Section 5200, et. seq.
SECTION 2. The City Council approves the Development Agreement by and between the City
of Eastvale and San Diego Outdoor Advertising, Inc. dba General Outdoor Advertising regarding
the construction of the Freeway Oriented Electronic Billboard, as set out in Exhibit "A", attached
hereto and incorporated as if fully set forth herein and the Mayor is authorized to sign it on
behalf of the City.
SECTION 3. Effective Date: This ordinance and the development agreement adopted by it shall
take effect 30 days from the date of the adoption of this Ordinance.
