Ordinance 14-010 0 ORDINANCE NO. 2014-01 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EASTV ALE, CALIFORNIA, AMENDING IN ITS ENTIRETY CHAPTER 10.02 OF TITLE 10 TO THE EASTV ALE MUNICIPAL CODE ESTABLISHING SPEED LIMITS ON CERTAIN STREETS WHEREAS, California Vehicle Code Section 22357 provides that local entities may declare prima facie speed limits greater than 25 miles per hour on City streets on the basis of an engineering and traffic survey; and WHEREAS, California Vehicle Code Section 40802 provides for the enforcement of the posted speed limit by the use of radar or other electronic devices which measures the speed of moving vehicles; and WHEREAS, California Vehicle Code Section 627(b) defines an engineering and traffic survey to include consideration of all of the following: 1) 2) Prevailing speeds as determined by traffic engineering measurements; Accident Records; 3) Highway, traffic, and roadside conditions not readily apparent to the driver; and WHEREAS, the City of Eastvale has completed a new engineering and traffic survey required under California Vehicle Code Section 22357. THE CITY COUNCIL OF THE CITY OF EASTV ALE, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Chapter 10.02 ofTitle10 to the Eastvale Municipal Code is amended in its entirety to read as follows: "Sec. 10.02.010.-Findings. (a) The City Council of the City ofEastvale fmds that an engineering and traffic survey has been completed in full compliance with the requirements of the California Vehicle Code and the recommendations in the survey should be implemented. Based upon the review of the survey and {00007270.DOCX Vl} 1 D l related information, the City Council finds the prevailing or 85th percentile speeds of the vehicles are: No. Location 1 65 1h Street 2 Hamner A venue 3 Schleisman Road Between Hamner A venue and East City Limit Citrus Street and Schleisman Road Hellman A venue and Archibald A venue 85th Percentile .(mnhl 38 51 50 (b) Based on the review of the Survey, the City Council finds that the most appropriate speed limits to facilitate the orderly movement of traffic that is reasonable and safe for the above-listed streets are set forth herein. Sec. 1 0.02.020. -Established. The following speed limits are as established: No. Location 1 65th Street 2 Hamner A venue 3 Schleisman Road Between Hamner A venue and East City Limit Citrus Street and Schleisman Road Hellman A venue and Archibald A venue (mph) 35 50 50 Sec. 10.02.030-Direction to City Traffic Engineer. On or after the effective date of the Ordinance of which this Chapter is derived, the City Engineer is directed to clearly post speed limit signs effectuating Section 10.02.020 above, to give notice that this Chapter is in effect." SECTION 2. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance, and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases or portions thereof be declared invalid or unconstitutional. {00007270.000< Vl} 2 [ [ [ SECTION 3.
